1. Scope of Application

These Terms and Conditions apply to all orders placed by consumers or businesses via our online shop at www.coopop.bike.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.

A business is a natural or legal person or a legal partnership who, when concluding the contract, acts in exercise of their trade or self-employed professional activity.

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the “Buy Now” button, you submit a binding order for the goods in your shopping cart.
Confirmation of receipt of your order is sent automatically by e-mail but does not yet constitute acceptance of your order.
The contract is concluded only when we explicitly confirm your order or by shipping the goods within 5 business days.


3. Prices and Shipping Costs

All prices are in euros and include the applicable statutory VAT.
Shipping costs are displayed separately during the ordering process.


4. Payment

The available payment methods are listed in the online shop.
Payment is due immediately upon conclusion of the contract.
If you choose financing via easyCredit, the terms and conditions of easyCredit additionally apply.


5. Retention of Title

The goods remain our property until full payment has been received.
For businesses, the retention of title also applies to claims arising from ongoing business relationships.


6. Delivery

Delivery times are specified in the online shop.
Deliveries are made exclusively to the delivery address specified during the ordering process.
If delivery is delayed by more than 4 weeks due to force majeure or unforeseen events (e.g., delays from manufacturers), both parties are entitled to withdraw from the contract.


7. Right of Withdrawal for Consumers

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day you or a third party designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Drive-Electro BW GmbH, Senefelderstraße 4, 48282 Emsdetten, Germany, E-mail: info@coopop.bike, Tel.: +49 (0)2572 / 9511358) of your decision by means of a clear statement (e.g., by e-mail or letter).
To meet the withdrawal deadline, it is sufficient to send the notification before the deadline expires.

Consequences of Withdrawal:
We will refund all payments received from you, including delivery costs (excluding additional costs for alternative delivery methods) within 14 days of receiving your withdrawal.
The refund will be made using the same payment method you used, unless otherwise expressly agreed.
We may withhold the refund until we have received the goods back or you have provided proof of return.
You bear the direct costs of returning the goods.
You are only liable for any loss in value if this loss results from handling beyond what is necessary to examine the nature, characteristics, and functioning of the goods.

Exclusion of the Right of Withdrawal:
The right of withdrawal does not apply to goods that have been manufactured to your specifications or clearly tailored to your personal needs.
The right of withdrawal also expires if you have expressly agreed that we begin fulfilling the contract before the withdrawal period has expired and you have confirmed your knowledge of the loss of your right of withdrawal.


8. Warranty

Statutory warranty rights apply.
For businesses, the following applies:

For new goods, the warranty period is 1 year from delivery.
For used goods, the warranty is excluded.
The reduction of the warranty period does not apply to damages resulting from injury to life, body, or health, or damages caused by gross negligence or intent.


9. Liability

We are fully liable for intent and gross negligence as well as for injury to life, body, or health.
In cases of slight negligence regarding essential contractual obligations, we are liable only for foreseeable, contract-typical damage.
Further claims for damages are excluded.
Liability under the Product Liability Act remains unaffected.


10. Place of Jurisdiction

For contracts with businesses, the place of jurisdiction is Emsdetten, Germany.
For consumers, the statutory provisions apply.


11. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
